Does this apply to you?

Does this apply to you?

There are two situations where the AI Act says you need a representative. Pick the one that sounds like you.

I build or sell an AI system

  • You're not based in the EU
  • Your AI is used in a sensitive area, things like hiring, credit decisions, exam grading, face or voice recognition, running utilities or transport. Or it is built into a product that already needs EU safety certification, like a medical device, machinery or a vehicle
  • You sell it to EU customers, or run it for them

Deadline

Rules apply from 2 December 2027 (or 2 August 2028 if it is built into a certified product). Your representative must be in place before you sell in the EU.

Article 22 AI Act · "high-risk AI systems" under Annex III and Annex I

This only applies if you build or sell the AI. If you just use someone else's AI tool, you don't need this.

I build a foundation model

  • You're not based in the EU
  • You provide a large general-purpose model, an LLM, image, audio or multimodal model, that others build on
  • You make it available to EU users or businesses

Deadline

Already applies, since 2 August 2025.

Article 54 AI Act · "general-purpose AI models"

Exempt if the model is fully open-source, with weights, architecture and usage info all public, and it isn't one of the most powerful models the EU classes as systemic-risk.

Not sure which you are? Many companies are both. Ask us and we'll tell you in plain English.

Your EU importers and distributors must check that you have a representative before they're allowed to sell your product.

The role

What the representative actually does

This isn't a mailbox. The AI Act gives your representative real jobs. Here's what we do for you, in plain terms.

  1. Check your paperwork before you launch

Before you sell in the EU, we confirm your technical file, your signed compliance statement and your compliance check are all done. If something's missing, we tell you what.

    ▸ Legal detail

The technical file is your technical documentation. The signed compliance statement is the EU declaration of conformity. The compliance check is the conformity assessment. For foundation models we verify the Annex XI documentation and the Article 53 duties instead.

  2. Keep your documents safe for 10 years

Regulators can ask to see your paperwork for a decade after launch. We hold it and hand it over if asked. You don't need to dig it out.

    ▸ Legal detail

We keep your contact details, the declaration of conformity, the technical documentation and any certificate from the certification body (notified body) at the disposal of the national regulators for 10 years after the system or model is placed on the market.

  3. Be the regulator's contact

If an EU regulator has questions about your AI, they come to us. We handle the request and pass you a plain-English summary of what's needed and by when.

    ▸ Legal detail

The signed appointment letter (the written mandate) lets the EU's AI regulator (the AI Office) and the national regulators address us in addition to or instead of you. On reasoned request we provide the information needed to demonstrate compliance, including access to automatically generated logs where you control them.

  4. Work with regulators if something goes wrong

If a regulator takes action on your system, we're on the call so you don't have to find a European lawyer at short notice.

    ▸ Legal detail

The Act requires the representative to cooperate with the regulators on any action taken in relation to the system or model, in particular to reduce and mitigate its risks.

  5. Register your system

Sensitive-use AI systems must be listed in the EU's public register. We do the registration or check yours is right.

    ▸ Legal detail

Registration in the EU database for high-risk AI systems under Article 49. Applies to Annex III systems, not to foundation models.

How the appointment works: It's a signed letter covering the specific systems or models you tell us about. The law requires us to end it, and tell the regulator, if a company stops complying. Clean paperwork protects you as much as it protects us.

Frequently asked questions

The questions founders ask us about the AI Act representative. Can't find yours? We're happy to help.

No. The rule applies to the company that builds or sells the AI (the legal term is provider). A company that just uses someone else's AI tool (a deployer) does not need a representative. If you build on top of a model and sell the result under your own name, you may count as a builder.

The AI system rule covers AI used in a sensitive area, like hiring, lending, education or biometrics, or built into a certified product. It applies from 2 December 2027. The foundation model rule covers large general-purpose models that others build on, and it has applied since 2 August 2025. Some companies fall under both and need one representative covering each. Legal basis: Article 22 and Article 54 AI Act.

Usually, yes. If your model is released under a free and open-source licence, and its weights, architecture and usage information are all public, you do not need a representative. The exemption does not apply if the model is one of the most powerful models the EU classes as systemic-risk.

For foundation models the rule is already in force, so yes. For sensitive-use AI systems the rules apply from 2 December 2027, but your representative must be in place before you sell in the EU. Your EU importers and distributors must also check you have one before they can sell your product. Appointing early avoids a launch block and gives time to fix paperwork gaps.

No. We check that your technical file, your signed compliance statement and your compliance check exist, and we keep them safe for regulators. If something is missing we tell you what it is. Completing them stays your responsibility.

The law requires us to end the appointment and tell the regulator if we have reason to believe a company is no longer complying. We would raise any concern with you first and give you the chance to fix it. Clean paperwork protects you as much as it protects us.

Possibly. The AI Act representative is a separate appointment from the GDPR, DSA and Data Act ones. If your AI handles personal data of people in the EU, you will usually need the GDPR representative too. A model served through an online platform may also trigger the DSA. All of them sit in one Gabsor account.

Because the representative has real legal duties and can be fined for failing them. The work and the risk depend on what you build: one system with complete paperwork is very different from a systemic-risk model. We scope each appointment and quote a fixed fee per system or model. Penalties: up to €15 million or 3% of worldwide annual turnover, whichever is higher.
