If you make connected products available in the EU or offer services covered by the Data Act there, but have no establishment in the EU, Article 37(11) of the EU Data Act (Regulation (EU) 2023/2854) requires you to designate a legal representative in the EU. The Data Act has applied since 12 September 2025.
Until you designate one, the competent authorities of every Member State may exercise jurisdiction over you, including imposing penalties. Appointing a representative consolidates that to one Member State.
