1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Gabsor ("Gabsor," "we," "us," or "our") regarding your use of our GDPR representative services and website.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Services

Gabsor provides GDPR compliance services, including but not limited to:

• EU and UK GDPR Representative services under Article 27
• Data Subject Request (DSAR) management
• Incident management and breach notification assistance
• Compliance monitoring and reporting tools
• Privacy Rights Portal (PRP)

The specific services provided to you are detailed in your subscription plan and any applicable service agreements.

3. Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use our services. By using our services, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

To access our services, you must create an account and provide accurate, complete information. You agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Provide and maintain accurate account information

5. Subscription and Pricing

5.1 Subscription Plans

Our services are offered on a subscription basis. Pricing is based on your annual turnover and selected representative jurisdiction (EU, UK, or Bundle). Current pricing is available at gabsor.com/pricing.

5.2 Payment Terms

• Subscriptions are billed monthly or annually in advance
• Annual subscriptions receive a 20% discount
• Payments are processed through our secure payment provider
• All fees are non-refundable except as required by law or stated in our refund policy

5.3 Free Trial

We offer a 7-day free trial for new customers. Your subscription will automatically begin at the end of the trial period unless you cancel before the trial expires.

5.4 Price Changes

We may change our pricing with 30 days' notice. Price changes will not affect your current subscription term but will apply upon renewal.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

Refunds are provided on a case-by-case basis. Contact our support team within 14 days of your initial purchase to request a refund.

7. Customer Obligations

As a customer, you agree to:

• Provide accurate information about your data processing activities
• Comply with all applicable data protection laws
• Respond promptly to our communications regarding regulatory matters
• Update your privacy policy to include our representative details
• Not use our services for any unlawful purpose
• Not attempt to circumvent any security measures

8. Our Responsibilities

As your GDPR representative, we will:

• Act as your point of contact for data protection authorities
• Receive and forward communications from authorities and data subjects
• Maintain records as required under GDPR Article 30
• Provide timely notifications of regulatory inquiries
• Assist with DSAR processing and incident management

9. Service Limitations

Our services do NOT include:

• Legal advice or representation in legal proceedings
• Data Protection Officer (DPO) services
• Full GDPR compliance audits or assessments
• Creation of privacy policies or legal documentation
• Liability for your data processing activities

10. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by Gabsor and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

11. Warranties and Disclaimers

We provide our services "as is" and "as available." While we strive for accuracy and reliability, we do not guarantee:

• Uninterrupted or error-free service operation
• That our services will meet all your specific requirements
• Complete accuracy of information provided through our platform

12. Limitation of Liability

To the maximum extent permitted by law, Gabsor shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Regulatory fines or penalties imposed on you

Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Gabsor harmless from any claims, damages, or expenses arising from your violation of these Terms, your data processing activities, or your breach of applicable laws.

14. Term and Termination

These Terms remain in effect while you use our services. We may suspend or terminate your access if you:

• Violate these Terms
• Fail to pay applicable fees
• Engage in fraudulent or illegal activities

Upon termination, you remain liable for all fees incurred and must cease using our services.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Nevada, United States. Any disputes shall be resolved in the courts of Nevada.

16. Changes to Terms

We may update these Terms periodically. We will notify you of material changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the updated Terms.
